-
Deposito di conferma: serve a garantire l'impegno reciproco tra il cliente e la struttura;
-
-
Codice del Consumo (articoli 33-36 del Decreto Legislativo 206/2005) – contro le clausole abusive o le penali eccessive;
-
Codice civile (artt. 1385 e 1386) – in materia di deposito cauzionale e penale;
-
|---|---|
| Clausola penale | Financial penalty for failure to perform the contract, but it must be proportionate to the damage . |
💡 Practical example: you paid a €200 deposit and the property cancels the reservation due to overbooking → you are entitled to €400 (double).
💳 Reservations on online portals (Booking, Airbnb, etc.)
Large portals must clearly indicate cancellation conditions and distinguish between:
-
refundable rates ,
-
non-refundable rates ,
-
terms and conditions of cancellation.
📌 If the cancellation was due to force majeure (illness, travel restrictions, portal errors), you can obtain a refund even on non-refundable rates by presenting adequate documentation.
🕐 How to request a refund
-
Contact the facility or portal in writing (email or certified email), asking:
-
full/partial refund,
-
or the refund of the deposit if the cancellation is legitimate.
-
-
Attach proof and documents : booking confirmation, cancellation policies, receipts.
-
Challenge unfair terms if the property did not clearly specify the penalties.
-
If they don't respond, file a formal complaint through a consumer association or the European ODR (Online Dispute Resolution) platform.
💡 Helpful tip: If you paid by credit card , you can request a chargeback (payment cancellation) from your bank if the service was not provided.
💬 Cases in which the penalty is not due
You don't have to pay penalties or you can get a refund if:
-
the property changes or cancels the reservation without reason;
-
the cancellation is due to demonstrable force majeure (illness, natural events, travel restrictions);
-
the penalty is disproportionate to the damage (e.g. 100% of the amount even if the cancellation is made weeks in advance).
💶 Practical examples
-
You cancelled 15 days in advance and the property retains 100% → you can contest it as an unfair clause ;
-
The facility closes for work and informs you of the cancellation → you are entitled to a refund + any compensation ;
-
“Non-refundable” booking but travel impossible due to force majeure → legitimate request for full refund .
